Haryana Government decides to allow the extension of parole of some 2017 convicts

Chandigarh, March 27 – Haryana Government has decided to allow the extension of parole/interim bail of 2017 convicts/undertrials, who are sentenced up to 7 years/facing trial for offences which stipulate maximum imprisonment up to 7 years, who were earlier released under the orders of High Powered Committee (HPC).

This decision was taken during the 13th meeting of the High Powered Committee held under the Chairmanship of Hon’ble Justice Rajan Gupta, Judge, Punjab and Haryana High Court and Executive Chairman, Haryana State Legal Services Authority and was attended by Advocate General, Haryana, Baldev Raj Mahajan, Additional Chief Secretary, Home Department, Rajeev Arora, Director General of Prisons, Haryana K. Selvaraj, IPS (Retd.) and District & Sessions Judge-cum-Member Secretary, Haryana State Legal Services Authority, Parmod Goyal.

            Sharing information in this regard, an official spokesperson of the Home Department said that the Committee has also reviewed the reports submitted by jail authorities regarding surrender of convicts under Phase-I, II and III in the meeting. It has been found that out of 879 convicts, 851 have surrendered, 8 convicts have been given extended parole by the High Court, 1 convict was released prematurely by the Government, 11 convicts have died, 8 convicts have absconded.

The Committee has further directed the undertrials to seek regular bail in accordance with law, if they are so advised.

High Powered Committee has also allowed COVID Vaccination to all inmates eligible under the criteria fixed by the Central Government on voluntary consent.

On account of difficulties being faced by Jail Authorities in conducting interviews, the Committee has accepted the recent proposal of Prisons Department for holding interviews of inmates with their family members, said the spokesperson.  He said that the Committee has permitted maximum number of 80, 120, 150 and 180 visitors per day, per jail, on all working days up to 4 pm in jails having capacity up to 1000, 1001 to 1500, 1501 to 2000 and 2001 or more respectively.  Counsels for inmates have been allowed to meet prisoners between 4 pm to 5 pm on all working days.

Besides this, the District & Sessions Judges-cum-Chairpersons, District Legal Services Authorities have been asked to visit jails once in a week.

The Committee in its last meeting held on February 11, 2021 directed the Jails Authorities for readmission of 2,580 convicts who were involved in heinous offences from February 23, 2021 in 9 staggered phases.  Now, in view of current strength of inmates in jails, surge in COVID-19 and ongoing readmission of 2,580 convicts, High Powered Committee has extended the parole / interim bail of 2017 (658+1359) convicts/undertrials who are sentenced up to 7 years / facing trial for offences which stipulate maximum imprisonment up to 7 years, till May 31, 2021. Jail authorities were directed to submit surrender plan by May 10, 2021.  The date of surrender be fixed on the basis of date of release.  Convicts/undertrials released earlier shall be first to surrender.

The High Powered Committee (HPC) was constituted at State level under the directions of Hon’ble Supreme Court of India issued on March 23, 2020 in Suo Motu Writ Petition (Civil) No.1/2020-In RE: Contagion of COVID-19 in Prisons for release of convicts/undertrials on parole/interim bail.
