Cases lingering for past 10 years resolved during Lok Adalat

The National Lok Adalat at Barnala today witnessed a decade old cases being settled through mutual consent.
Giving this information here today Sh. Virinder Aggarwal, Ld. District & Sessions Judge-cum-Chairman, District Legal Services Authority, Barnala, informed total 687 cases were taken up in this National Lok Adalat through physical appearance of the parties and through E-Lok Adalat and out of which 610 cases were disposed of and awards of Rs. 2,32,24, 113 were passed.
He told that judicial officers worked very hard in this COVID-19 period and made efforts in Pre-Lok Adalats and prevailed upon the parties to enter into compromise and finally awards were passed in National LokAdalat.
In two civil matters, 10 years old litigation has been ended today. An arbitration matter bearing no. ARB/08/2016 titled as M/s Standard Corporation (Barnala) India v/s M/s Clutch lnter-national was registered on 13.07.2016 for setting aside the award passed by the sole arbitrator. The applicant firm engaged in manufacturing, assembling of combine harvesters, tractors and allied agricultural machinery and other heavy lift machinery and the respondent is engaged in manufacturing of fly wheels, ring gears and shafts were having regular business dealings. A dispute arose between the parties prior to 01.09.2012. These parties approached the Sole Arbitrator. An Award dated 10.05.2016 was passed by the Arbitrator in favour of respondents M/s Clutch international, On, 13.07.2016, the applicant M/s Standard Corporation lndia approached the Court for setting aside the said Award. Now, after a long litigation of about 10 years, the parties have come to the compromise and the applicant has withdrawn the present Arbitration application in the National Lok Adalat held today.
In another 9 year old case, a complaint was filed on 11.10.2012 by complainant Bittu Slngh against Kamla Devi and ors. u/s 323,324,506, 34 IPC and u/s 3 and 4 of SC/ST Act which was dismissed by the Court of Sh. Ranjeevpal Singh Cheema, the then JMIC Barnala on 13.07.2017. Against the order, complainant Bittu Singh filed revision petition which was pending in the court of Sh. Barjinder pal Singh Ld. Addi. Sessions Judge, Barnala.
In the National Lok Adalat held today, with the efforts of Sh. Barjinder Pal Singh, a compromise has been effected between the parties and the revision petition has been withdrawn by the complainant Bittu Singh.
In yet another 10 year old dispute, two civil suits (for possession and declaration) bearing no. 468 of 07.05.2011 and 506 of 15.06.2011 titled as Thakur Dwara, Bahrla Tapa v/s Sewak Das and Thakur Dwara, Bahrla Tapa v/s Madhu Sudan Das were filed by Thakur Dwara Bahrla Tapa against Sewak Das and Madhu Sudan Das. Both the civil suits were decided by the court of Civil Judge (Sr. div.) Barnala on 20.04.2019. Against the said judgments and decrees, Madhu Sudan Das and Sewak Das moved civil appeals which were pending in the court of Sh. Barjinder Pal Singh, Additional Sessions Judge, Barnala. A compromise between the parties, has been effected by the efforts made by Sh. Barjinderpal Singh in the National Lok Adalat and long litigation of more than 10 years regarding religious place i.e Thakur Dwara, Bahrla Tapa has come to an end and civil appeals have been withdrawn by the parties.
Sh. Virinder Aggarwal said that to dispose all type of Pre-Litigative and pending cases by compromise, total 6 benches of Sh. Barjinder Pal Singh Ld. Addi. District & Sessions Judge-I, Sh. Kapil Aggarwal Ld. District Judge, Family Court, Sh. Vineet Kumar Narang Ld. Civil Judge (Sr. Div.), Smt. Surekha Rani Ld. Addi. Civil Judge (Sr. Div.), Sh. Chetan Sharma Ld, Civil Judge Ur. Div.) and Sh. Vijay Singh Dadwal Ld. Civil Judge (Ir. Div.) were constituted.
He added that there are lots of benefits of these National Lok Adalats like speedy disposal of cases, award of Lok Adalat is deemed to be the decree of the Civil Court, no appeal lies against the award of Lok Adalat and further decisions are taken through compromise which leads to peace and tranquility among the parties and society of large, orders regarding refund of entire Court fee are made, decisions are final in nature etc. He also informed that if any litigant is willing for settlement of this dispute through National Lok Adalat he can request the concerned Presiding Officer of the Court where his case is pending or in case of Pre- Litigative matters, request can be made to Secretary, District Legal Services Authority, Barnala for taking up his/her case in the Lok Adalat In the end, he appealed people to take maximum benefit of these Lok Adalats and get speedy disposal of their disputes in future National LokAdalats to be held on 11.09.2021 and 11.12.2021
