Haryana Policy for creating Land Bank Notified

Chandigarh, August 11 – Seeking to serve the twin objectives of preventing the land owners from resorting to distress sale of land, and making land available to different departments of the state government for setting up essential public services, the Haryana Revenue and Disaster Management today notified the policy for creating Land Bank.

According to the policy, the Revenue Department will consolidate such chunks of surplus land as had been acquired by the departments under the Land Acquisition Act, 1894 (Central Act 1 of 1894) but do not need now, and provide it to the departments that need them most. It will also make things easy for the state government which has been experiencing a lot of difficulty in making land available to the departments.

Giving further information in this regard Financial Commissioner Revenue and Additional Chief Secretary, Sh. Sanjeev Kaushal said that it has been observed that landowners at times have to make distress sale of their land especially those living abroad due to slump in market or due to pandemic, pressure of  middlemen in the market a plethora of other reasons. The bank will offer a win-win situation for departments and land owners/farmers, and the state government. While the former will be able to sell land at a competitive price, the latter would not have to look the other way when any department knocks at their door for land for setting up public utilities.

He said that the bank would provide land to departments for setting up essential services, including water works, power sub-stations, colleges and other specialized institutions of higher learning, including universities, medical colleges, hospitals and polytechnics etc.

The bank will be set up under the Policy for Purchase of Land Voluntarily Offered to Government For Development Projects, Creating Land Bank for Government Department, including Boards and Corporations.

Online portal for taking offers

Landowners selling their land to avoid distress sale due to any eventuality including market trends can offer to obtain a competitive price from the Government for its present and future needs for providing essential infrastructure including future projects to create a land  bank. The landowners or farmers should apply on the online portal of the Director, Land Records, to make an offer of his land to the state by giving complete details of land, including negotiable price of the same.

The portal shall be created by the Director, Land Records, to enable land-owners / farmers to make offers to sell land at any time mentioning land details. The applicant must enclose relevant land records and quote their expected rate while submitting the online application.

Verification by the Revenue team

The title of the property including ownership, khasra numbers shall be verified online from the Web-HALRIS portal by the officers/officials of the Directorate. It is to be ensured that the offer of land is in complete khasra number(s) with specific karukan (length & breadth i.e. field book) and not in share in any manner, as per ownership column of the jamabandi.

The Directorate of Land Records shall upload details of lands of various Government Departments, and their entities i.e. the Boards and Corporations, Panchayat Deh and Municipal Bodies in all the revenue estates of the State by taking the assistance of Asset Management Cell of the Department etc. so as to examine the feasibility of making optimum use of such lands in accordance with the relevant statutes, rules and policies applicable.

Examination by land and Rate Scrutiny Committee

This Committee headed by Administrative Secretary, Urban Local Bodies shall examine the report made by the O/o Director, Land Records. This Committee shall ensure that there is no court case pending on the land being sold and shall finalize the offers as early as possible so as to enable to inform the landowner/farmer about the decision taken within a maximum period of six months from the date of offer made.

Principal Decision of Land Bank Committee

The Committee headed by Financial Commissioner Revenue and Additional Chief Secretary, Revenue and Disaster Management Department shall finalize in principle the land offers made by the farmers for creating a land bank and making recommendation to High Powered Land Bank Committee headed by Chief Minister.

Effecting the purchase of land and disposal thereof

Upon clearance by the Land Bank Committee, the offer made by the landowners/farmers shall be placed before the High Powered Land Bank Committee. Immediately after finalization of land purchase, a sale deed will be executed in favour of State Government in the Revenue Department by taking possession thereof simultaneously by the Deputy Commissioner concerned. This will be a part of land bank.

If the land purchased from private individuals is not required for a long time, this committee can take decision to e-auction it by a transparent manner, so as to be in unison with the State Revenue, on the recommendation of Land Bank Committee after exploring all possibilities of present and future requirements of various Departments of Government including Boards & Corporations.
