Haryana Right to Service Commission has taken suo motu cognizance in two separate cases for non-delivery of notified services within the stipulated time-limit. With this it has become clear that officers or employees will not be able to cause delay in the delivery of notified services.

Chief Commissioner, Haryana Right to Service Commission, Sh. TC Gupta said that on receiving a complaint, Senior Accounts Officer, MSME Department, Sh. SK Kaushik was issued a suo motu notice to appear before the Chief Commissioner on September 15. Sh.  SK Kaushik and Accounts Officer, Ms. Usha Rani appeared before the Chief Commissioner on September 27 and informed that this scheme is being dealt with by the Directorate of MSME while the notice was issued to the Industries and Commerce Department. Sh. SK Kaushik stated in his written reply that due to the ceiling imposed by the Finance Department, the payment could not be made within the stipulated period of 7 days. But when asked about the delay of more than 10 months against the notified period of 45 days, he was not able to provide a reply.

Sh. TC Gupta informed that this is a serious matter and hence suo motu notice to Additional Chief Secretary (Finance) and Director, MSME for delay in delivery of services under Service No.130 of Haryana Right to Service Act, 2014 has been issued. Also, they have been directed to appear before the Commission in person or through video conference at 12:30 pm on October 18.

Chief Commissioner, Sh. TC Gupta said that the second case is of PGIMS, Rohtak. The Deputy Commissioner, Rohtak, informed through an e-mail on  September 29 that reports are being published in local newspapers to the effect that PGIMS Rohtak does not have accurate information about deaths due to COVID-19. The reason for this was said to be missing files. The death toll was reported to be up to 80 as against 23 earlier due to which the Deputy Commissioner, Rohtak was flooded with complaints regarding non-issuance of death certificates by PGIMS, Rohtak. It was also informed through e-mail that even after raising the matter several times before the office of Director, PGIMS Rohtak by the Deputy Commissioner Rohtak, neither was attention paid to it nor were the birth and death certificates uploaded by the concerned employee on the Saral portal. It was also stated that the notified time period for grant of this certificate is 21 days, but such cases are pending since April. However, for service number 23 in the list of notified services, a time limit of 14 days has been prescribed for issuance of birth or death certificates during the current year.

Sh. TC Gupta said that for failure to deliver the notified service within the stipulated time frame, suo motu notice has been issued to the Director, PGIMS Rohtak and has been asked to explain the reasons for the delay in service delivery. Also, the Director of PGIMS Rohtak has been directed to appear before the Commission in person or through video conferencing on October 11 at 11:30 am to present his case in the matter.
