Chandigarh, March 31 :- The mandate of the Haryana Right to Service Commission is to ensure that no citizen is harassed in availing any benefit of the service notified under Haryana Right to Service Act, 2014 from Government offices and also to ensure the delivery of the services in a time bound manner. The Commission is stringent against the officers who take laxity in their approach towards work. Recently, in a case, Haryana Right to Service Commission has imposed a penalty of Rs. 20,000/- on Additional Director, MSME, Sh. Shashi Kant for not ensuring delivery of service-Energy Audit Scheme for MSMEs as per the given timeline. The complainant file was pending for almost one and a half year. After the intervention of the Right to Service Commission (RTS) the case reached its logical end.
Giving detailed information in this regard, an official spokesperson said that Sh. Narender Kapoor had applied for Energy Audit Assistance Scheme for his business unit located in Faridabad on September 4, 2020 which is being provided by the Directorate of MSME. He added that the applied request stayed in pendency for almost one and a half years and no satisfactory reply was furnished by the department. He further added that Sh. Narender Kapoor submitted a complaint to the Commission and post receiving the complaint the Commission immediately took cognizance of the matter. Consequently, a suo moto notice was issued to the Director, MSME to conduct an inquiry and fix responsibility for the delay. Thereafter, a committee was formed by the Director, MSME for inquiry and in the furnished report, the committee cited generic reasons for delay and that no officers can be singularly held accountable for the delay.
After finding the report to be simply an eye wash, the Commission directed the Director, MSME to depute concerned Additional Director to appear before the Commission with a record of the case on March 25, 2022. Additional Director, MSME appeared before the Commission. During the hearing, Sh. Shashi Kant was unable to even cite the RTS timeline for the service in question correctly, which confirmed that negligence was on his part. During the inquiry Sh. Shashi Kant revealed that a committee was formed on July 1, 2021 in the case on 01.07.21 on his approval and the report was furnished after a long delay on November 7, 2021. He also conceded that being the Designated Officer for the service, he should have followed up to ensure timely reporting by the Committee. It was also observed that another committee was formed on December 23, 21 by the Director, MSME to carry out the same verification again, leading to further delay in the case. After the inquiry, the Commission held Sh. Shashi Kant responsible for delay in delivering services to the applicant for whom the commission has imposed a fine of Rs. 20,000 to be deposited in the State Treasury within 30 working days and also awarded a compensation of Rs. 5,000 to the complainant. Director, MSME has also been issued a show cause notice to explain the need for re verification ordered by them. The Commission has also identified multiple such delays on part of Directorate of Industries and Commerce and Directorate of MSME.
The spokesperson informed that the Commission will be holding inquiries with HODs of both the Directorates to streamline processes and fix responsibility for delays, wherever identified. He added that the commission will not spare any officer concerned who does not respect work ethics and is not committed to perform tasks on time.
He further added that due to the commission’s strict approach the delivery of the services have now been accelerated at a faster pace in all the departments which is the ultimate mandate of the commission.
