Ludhiana,30 jun 2021
Ludhiana residents would have read about the launch of much awaited local modernized cyber cell on June 29. Hopefully, now the sufferers won’t have to depend only on state cyber cell, Mohali.
In fact, pick up any newspaper and you’d notice reports regarding online credit card frauds, online banking frauds, social media account hacking etc. Even pensioners are being defrauded with their lifelong savings to be left with nothing to spend the rest of their life on.
One cyber crime case that took place at a Ludhiana firm has eventually become a landmark case of Supreme Court and is being quoted at most of the legal forums and legal academia across the country.
The case is about some ex-employees in Sales and some in IT , Ramandeep Singh, Rahul Nagpal & others of a Ludhiana based edtech firm TCY with one of its franchisees Jagjeet Singh and stealing the firm’s data and other online tools and materials to set up a small business and selling the same programs at throw away prices in India and abroad. TCY was established over two decades back and the accused’s firm fourmodules.com was established in 2018 soon after they left their employers.
The complaint was given in Sept. 2020. The state cyber cell, Mohali registered the case in Oct, 2020 & raided the premises of the accused in November, 2020. The roles of all the employees found there is being investigated to unearth the conspiracy.
In the mean time accused’s anticipatory bails were rejected by the High Court in March earlier this year and later by the Supreme Court in April.
After the anticipatory bail dismissals at Mohali in November, 2020, the accused approached the Hon’ble High Court. While dismissing their bails again, the Hon’ble HC clearly directed the police in March for custodial interrogation to unearth the modus operandi of the accused. After the Supreme Court upheld the decision while giving a landmark judgment, it soon became a news all over the nation . We got to know when people from different parts of the country started approaching us and appreciating for fighting this menace persistently. Any one can search online for the SC judgment. There’s a lot to learn from this case as it’s likely to set a good example. After all, if such parasites are not brought to justice, how do we expect businessmen to set up their IT firms in Punjab. After reading such rulings, do you think big firms will be willing to make investments in Punjab ? We’re not sure when the police will interrogate these culprits to implement the court orders “, said Ghai.
