Lok Adalat held in Barnala, 925 cases resolved, claims worth Rs 5 cr settled

Six years old pending case pertaining to sale of land resolved
Cases of man accused of not repaying loans too settled amicably

During the National Lok Adalat held at Barnala today of the 1260 cases put up before the court, 925 have been settled claims worth Rs 5.17 cr.
In a press statement issued here today Virinder Aggarwal, District & Sessions Judge-cum-Chairman, District Legal Services Authority, Barnala informed that to dispose of all type of Pre-Litigative and Pending cases by compromise, total 8 benches of Sh. Barjinder Pal Singh Ld. Addl. District & Sessions Judge-I, Sh. Kapil Aggarwal Ld. District Judge, Family Court, Sh. Kuljit Pal Singh, Ld. Chairman, Permanent Lok Adalat (PUS), Sh. Vineet Kumar Narang Ld. Civil Judge (Sr. Div.), Smt. Sucheta Ashish Dev Ld. Chief Judicial Magistrate, Smt. Surekha Rani Ld. Addl. Civil Judge (Sr. Div.), Sh. Vijay Singh Dadwal Ld. Civil Judge (Jr. Div.) and Ms. Babaljit Kaur Ld. Civil Judge (Jr. Div.), were constituted.
Virinder Aggarwal, Ld. District & Sessions Judge, Barnala informed that total 1260 cases were taken up in this National Lok Adalat and out of which 925 Cases were disposed of and awards of Rs. 5,17,52,164.51/- were passed. He told that judicial officers worked hard in this COVID-19 period and made efforts in Pre-Lok Adalats and prevailed upon the parties to enter into compromise and finally awards were passed in National Lok Adalat.
He added that in Civil Appeal no. 381/2018 titled as Meena Rani vs Jaspal Singh is outcome of Civil Suit bearing no. 221/08.12.2015 filed on the basis of the agreement to sell 15.05.2015 and suit was decreed on 22.03.2017 in favour of Meena Rani. An appeal was preferred by Jaspal Singh against the said judgment. During the pendency of appeal sale deed was executed in favour of the plaintiff present respondent through the process of court in the execution filed by Meena Rani. During the pendency of appeal with the persuasion of Sh. Virinder Aggarwal, Learned District & Sessions Judge, Barnala, parties entered into compromise and as per compromise appellant/ defendant returned the sale consideration amount to the plaintiff/ respondent and plaintiff/ respondent as per compromise executed back the sale deed of property in question in favour of appellant/ defendant on 09.09.2021. After a long litigation of more than 6 years the parties have compromised the matter and both the parties went happy.
The biggest story of the National Lok Adalat is settlement in six appeals relating to Yograj, a resident of KC Road area in Barnala bearing no. CRA-11-2021, CRA-10-2021, CRA-146-2019, CRA-9-2021, CRA-116-2020 and CRA-39-2020.
Yograj has taken loans from various persons 6-7 years earlier and to repay the loans he issued cheques to those persons. He went broke and was unable to arrange for money required for encashment of cheques. These were dishonored when presented in banks. Number of complaints were filed against him under Section 138 Negotiable Instrument Act. He was convicted in number of complainants and was sentenced. Complainants were under fear of losing their hard earned money. Yograj has challenged these convictions while preferring appeals and appeals were also preferred against him by complainants for enhancement of sentence and claim of compensation. In five such appeals filed by Yograj against his conviction and sentence of these appeals are out of the complaints filed by Sinesh Gupta, Jeewan Kumar, Rakesh Kumar, Urmila Devi and Satya Devi and one complaint filed by complainant and compromise was effected with the efforts of Sh. Virinder Aggarwal, Learned District & Sessions Judge, Barnala and Sh. Barjinder Pal Singh, Additional Sessions Judge, Barnala. These compromises have come as a big relief to Yograj whose sentence in five cases has been condoned and complainants were also able to get back their lost money and are able to secure the remaining amount as Yograj has promised to pay the remaining amount to them. All the complainants have no connection with each other.
This series of compromises effected in National Lok Adalat has given much needed relief to people of area of Barnala as number of persons are now hopeful of getting back their lost money.
Sh. Virinder Aggarwal, District & Sessions Judge Barnala also informed that there are lots of benefits of these National Lok Adalats like speedy disposal of cases, award of Lok Adalat is deemed to be the decree of the Civil Court, no appeal lies against the award of Lok Adalat and further decisions are taken through compromise which leads to peace and tranquility among the parties and society of large, orders regarding refund of entire Court fee are made, decisions are final in nature etc. He also informed that if any litigant is willing for settlement of his/her dispute through National Lok Adalat he/she can request the concerned Presiding Officer of the Court where his/her case is pending or in case of Pre-Litigative matters, request can be made to Secretary, District Legal Services Authority, Barnala for taking up his/her case in the Lok Adalat. In the end, he appealed people to take maximum benefit of these Lok Adalats and get speedy disposal of their disputes in future National Lok Adalat to be held on December 11.
